Have you started to plan and prepare for your visa extension?

Your Visa Journey

The Skilled Worker visa route is a crucial journey for many individuals looking to build a life in the UK. Whether you’ve been in the UK for a couple of years or you’re approaching the end of your leave period, the time will come when you need to consider extending your visa. Early planning and preparation are key to ensuring a smooth process and avoiding any delays or refusals on your extension. In this blog we’ll help you understand everything you need to know about extending your Skilled Worker visa.

Timelines Matter

The timing is crucial when it comes to extending your Skilled Worker visa. Although you cannot apply for your Skilled Worker visa extension more than three months in advance of your visa expiry, you will need plenty of time to gather the necessary documents and to ensure that your employer is compliant and prepared.

In order to apply for your Skilled Worker visa extension you will need a new Undefined Certificate of Sponsorship (CoS) from your sponsor. Once your employer has made a request for an Undefined CoS it can take up to 18 weeks to be granted by the Home Office. However, there are priority service options available. It is vital to consider this timeline when planning to extend your visa. The Home Office may also request additional information during this process, typically giving your employer a 5-working-day deadline to provide it.

Leave Expiry

It is important that your leave does not expire whilst you are waiting for a new Certificate of Sponsorship. If you end up overstaying as a result of any delays your future visa applications are likely to risk refusal.

If you submit a visa extension after your leave expiry this will likely be refused due to you not having valid leave to be in the UK. However, there may be circumstances where you are able to submit a valid application after your leave expiry. If your leave is expired and you wish to explore your options you can contact our team for advice.
